Terms of Use (EULA)

1. Acceptance of Terms

These Terms of Use ("Terms"), including our End User License Agreement ("EULA"), constitute a legally binding agreement between you ("User", "you", or "your") and Fasoop ("we", "our", or "us"). These Terms govern your access to and use of the Fasoop mobile applications for iOS and Android, our website at fasoop.com, and all associated services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall and discontinue using the Service.

2. Apple App Store & Google Play Terms

If you downloaded the Service via the Apple App Store, this agreement also incorporates Apple's Standard Licensed Application End User License Agreement:

In the event of any conflict between these Terms and the Apple Standard EULA, these Terms shall control to the extent of such conflict. You acknowledge that these Terms are concluded between you and Fasoop only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its contents.

3. Nature of Service (Directory Intermediary)

• Independent Contractors: Service providers and taxi drivers listed on Fasoop are independent contractors and are not employees, agents, joint venturers, or representatives of Fasoop.
• Direct Agreement: Any agreement, negotiation, quotation, schedule, or payment for offline services or taxi rides is strictly between the customer and the independent service provider or driver.
• No Guarantee or Endorsement: Fasoop does not endorse, guarantee, or warranty the quality, safety, legality, licensing, punctuality, or pricing of any provider or taxi listed on the platform. Users are urged to exercise independent judgment and verify qualifications before hiring.

4. User Accounts

To access certain features, including listing your services or vehicle, you must create an account verified by mobile phone OTP. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your mobile device and authentication OTPs.
• Notify Fasoop immediately of any unauthorized use of your account.

5. Service Provider & Taxi Driver Obligations

If you register on Fasoop as a service provider or taxi driver, you represent and warrant that:

• You hold all necessary business licenses, driving permits, commercial vehicle fitness certificates, and insurance policies required by local law.
• Your vehicle is properly maintained, insured, and compliant with all regional motor vehicle laws.
• All information, photographs, and videos submitted in your profile and listings are truthful, current, and depict your actual services or vehicle.
• You will treat customers with professional courtesy and adhere to all safety and consumer standards.

6. Subscriptions, Payments & Auto-Renewal

While searching and contacting providers is free for customers, providers and drivers may subscribe to listing plans to feature their services or vehicles on the directory.

A. Billing & Charges

Subscription fees are clearly displayed in the app prior to purchase. Payments will be charged to your Apple ID account (for iOS users) or Google Play account (for Android users) at confirmation of purchase.

B. Automatic Renewal

Subscriptions automatically renew yearly or monthly (as chosen during checkout) unless auto-renew is canceled at least 24 hours before the end of the current subscription period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price and tier as originally selected, unless notice of price change is provided in advance.

C. Managing and Canceling Subscriptions

You can manage your subscriptions and turn off auto-renewal at any time:

• On iOS (iPhone / iPad): Open Settings → tap your Apple ID / Name at the top → tap Subscriptions → select Fasoop → tap Cancel Subscription.
• On Android: Open the Google Play Store → tap your Profile Icon → tap Payments & Subscriptions → tap Subscriptions → select Fasoop → tap Cancel Subscription.

D. Refunds

All subscription purchases are final and non-refundable, except as required by applicable law or the refund policies of Apple Inc. or Google LLC. Cancellation will take effect at the conclusion of the active billing cycle, and your listing will remain active until that cycle ends.

7. User Content & Prohibited Conduct (UGC)

You are solely responsible for any text, photos, reviews, or videos you upload ("User Content"). You agree not to post content or engage in conduct that:

• Is fraudulent, defamatory, obscene, harassing, threatening, or violates intellectual property rights.
• Involves impersonation, false pricing, bait-and-switch listings, or unlawful services.
• Contains malware, spam, phishing schemes, or interferes with the normal operation of the Service.

Fasoop reserves the right, in its sole discretion and without prior notice, to review, reject, or remove any listing or content that violates these Terms or harms our community.

8. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FASOOP, ITS FOUNDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE;
• ANY DISPUTE, TRANSACTION, INJURY, PROPERTY DAMAGE, OR CONDUCT BETWEEN YOU AND ANY THIRD-PARTY SERVICE PROVIDER OR TAXI DRIVER;
• ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT OR DATA.

9. Indemnification

You agree to defend, indemnify, and hold harmless Fasoop and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at our discretion, without notice or liability, for conduct that violates these Terms or is harmful to other users, third parties, or our business interests. You may terminate your account at any time by utilizing the in-app account deletion tool or contacting our support team.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Kerala, India.
